There are indications that the petition filed by DAWARI GEORGE of the APC for Federal Constituency has been reinstated by the Court of Appeal.
DAWARI GOERGE is challenging the victory of his PDP rival, BOMA GOODHEAD in the election for Asari-Toru/Akuku-Toru Federal Constituency.
However; the National and State Assembly Tribunal had in July dismissed his petition for lack of competence on grounds of non compliance with the 21-day deadline for filing of nomination forms are required by the Electoral Act.
But the Court of Appeal is reported to have overruled the tribunal on the issue of 21 days notice, affirming that the question of eligibility cannot arise since the petitioner qualified as APC candidate for the election.
You will recall that another petition filed by LUCKY ODILI also of the APC for Ogba-Egbema-Ndoni Federal Constituency suffered a similar fate, after it was dismissed by the tribunal headed by Justice ADAMU GUMBA.
ODILI, who is challenging the victory of Prince UCHE NNAM-ONI of the PDP, is also before the Court of Appeal seeking to reverse the decision of the tribunal.
