Rivers State High Court strike out suit by Rivers elders

Sara-Igbe and nine others had filed a suit against the defendants, seeking constitutional interpretation of whether the purported peace pact signed to resolve the political impasse in the state is in line with the constitution.

The claimants also asked for the interpretation of the Nigeria Constitution and whether the president has the constitutional right to direct the governor to re-present the 2024 budget to twenty-four members of the House of Assembly led by Amaewhule, even after their seats were declared vacant following their defection.

Today FM’s Uchendu Ejiowhor reports that when the matter came up for motion of substituted service, the presiding judge, Justice Chinwendu Nworgu declined jurisdiction to entertain the suit, sighting the judgment of Justice James Omotosho of the Abuja High Court which nullified activities of Edison Ehie led faction of the Assembly.

Addressing newsmen after the court hearing, one of the counsels to the claimants, Emmanuel Rukari expressed disappointment over the position of the court, saying that the ruling is an indication that Judiciary is not a hope for a common man.

On his part, Sara-Igbe said the case would be appealed.
