The tribunal ruled that the evidence provided by the petitioners was inadequate to justify the allegation of non-compliance to the Electoral Act of 2010, adding that the petitioners where unable to discharge the burden of proof.
Similarly; the tribunal also dismissed the petition of ROBSON DRESSMAN of the APC, challenging the election of AWAJI IBANI of the PDP for Andoni State Constituency in the Rivers State House of Assembly
DRESSMAN had argued that the election was conducted in violation of the electoral act of 2010 as amended, but after striking out some paragraphs in the petition that were considered invalid, the Tribunal went ahead to strike out all the grounds of the petition for lacking in merit.
Furthermore; the tribunal also yesterday upheld the election victory of BARIKO BARIATE of APC for Gokana State Constituency in the Rivers State House of Assembly, on grounds that the PDP challenger failed to prove beyond reasonable doubt his allegations of violence, intimidation and noncompliance with the Electoral Act.
