Professor Ogbonna was first arraigned by the Rivers State Police command on a one count charge of rape and sexual assault of the twenty year old student of the department of Micro-Biology in RSU,before the Rivers State government indicated interest to take over the prosecution of the matter.
The accused however, pleaded not guilty to the offence which is said to be punishable under section three hundred and sixty of the criminal code, CAP thirty-seven of the laws of Rivers State, Nigeria 1999, and was granted bail to make way for full trial of the matter with all the processes completed including final written addresses.
When the matter came up for judgement yesterday, parties were informed of the absence of the presiding Chief Magistrate, Poromon Menenen, and were directed to choose a new date when judgment will be delivered.
The parties further agreed to return on 25th of September, for judgement.
