Delivering judgment on the application, the seven-member panel of the Supreme Court presided by Justice SYLVESTER NGWUTA dismissed the application of APC and DAVID LYON for lacking in merit.
The apex Court said though it was infallible, the APC application is an abuse of court processes.
Justice AMINA AUGIE who read the judgment said the decisions of the Supreme Court are final.
She added that the applicants failed to point out errors, stating that the judgment is final for all ages.
The apex court judge said the judgment is final in the ‘real sense’ and no court on earth can review the judgment.
She was quoted as saying that; “There must be an end to litigation even if we review this judgment, every disaffected litigant will bring similar applications and the finality of Supreme Court judgments will be lost.”
She added that the applications are frivolous and vexatious, and awarded the cost of ten million naira against DAVID LYON and his party, the APC to be personally paid by their Lawyers, AFE BABALOLA and WOLE OLANIPEKU, both Senior Advocates of Nigeria.
