The trial of pro-Biafra agitator, NNAMDI KANU, continued today at a Federal High Court sitting in Abuja.
The Department of State Security Service is seeking the consent of Justice JAMES TSOHO for the protection of prosecution witnesses in the trial.
The prosecution counsel, DAVID KASWE told the trial judge that there was a possibility for the witnesses to refuse to testify against the leader of the Indigenous People of Biafra, without a guaranty that their identities would be protected.He argued that most of the witnesses were civilians who reside in the location of the accused person, which makes them vulnerable of being influenced.However; counsel to NNAMDI KANU, CHUKS MUOMA, opposed the application, stressing that what the prosecution was asking for amounts to secret trial.The Senior Lawyer prayed the court to draw a distinction between a closed trial and protection of witnesses.
He equally cited section 364 of the 1999 Constitution as amended, stressing that there was no provision for masquerades to testify as witnesses in a case of the nature for which his client was being prosecuted.CHUKS MUOMA argued that protection of witnesses could only apply to terrorism cases, while KANU is facing charges of treasonable felony.
