The Supreme Court has ordered Senate President, BUKOLA SARAKI to face criminal prosecution over allegations of false declaration of assets.
Senator SARAKI had challenged his criminal prosecution before the Code of Conduct Bureau, but his appeal has been dismissed by the Supreme Court.
In a lead judgment read by Justice WALTER ONNOGHEN, the apex court ruled that the Code of Conduct Tribunal was properly constituted and enjoys jurisdiction over the case for which Senator is being prosecuted.Justice ONNOGHEN said there was no merit in the question about whether the CCT can preside over the case and issue bench warrants against Senator SARAKI. By dismissing all grounds of the appeal, the Supreme Court upheld the judgment of the Court of Appeal for the trial of the Senate President to continue.The Supreme Court had on 12th of November last year asked the CCT to stay proceedings on the SARAKI case, pending the outcome of his appeal.
This was after the defence lawyers led by JOSEPH DAODU, who is a Senior Advocate of Nigeria, staged a walkout of the Code of Conduct Tribunal, because it insisted on going ahead with the prosecution of SARAKI.You will also recall that it took the CCT issued series of threats and warrants of arrest before Senator SARAKI surrendered himself to be ducked before the tribunal.The Senate President formed a habit of going to the Tribunal with an entourage of Senators.
