Former National Security Adviser, retired Colonel SAMBO DASUKI will on Monday next week know whether criminal charges against him will be dropped.
Justice HUSSEIN BABA-YUSUF fixed the date for ruling after the defence and prosecution counsel, JOSEPH DAODU and ROTIMI JACOBS addressed the court on a motion for the release of DASUKI.DAODU who is a Senior Advocate of Nigeria want the court stop the Federal Government from further prosecuting his client until the bail granted by the court is enforced.The senior lawyer is of the opinion that the government cannot lawfully prosecute DASUKI, having been in contempt of the court.The motion is based on the order of Justice YUSUF granting DASUKI bail on 18th of December last year, but he was rearrested by the Department of State Services on 29th December after perfecting his bail conditions.In opposing the motion, the prosecution counsel, ROTIMI JACOBS who is also a Senior Advocate of Nigeria, said the move by the defence was an abuse of court process.He said there was no evidence placed before the court that the accused was rearrested by the Economic and Financial Crimes Commission, which is prosecuting the case.The EFCC lawyer suggested that DASUK should rather invoke section 46 of the constitution and institute a civil action to enforce his fundamental right to personal liberty.
