The appeal was filed by the sacked twenty-three local government chairmen and their councilors, who are mainly drawn from the All Progressives Congress.
They are challenging the ruling by former Federal High Court Judge, Justice LAMBO AKANBI which dismissed their request to be joined in the matter.
When the case resumed today, counsel to the Rivers State Independent Electoral Commission, CHUKWUMA EKE, filed a motion for stay of proceeding at the appeals court.
The RSIEC counsel argued that the Court of Appeal cannot continue to hear the matter since the parties have another appeal before the Supreme Court.
But SEBASTIAN HON, who is the lawyer to the sacked council chairmen and councilors, opposed the application, arguing that the matters before the Supreme Court and the Appellate Court are not similar.
After listening to the submissions; the Presiding Appeals Court Judge adjourned the case till 28th February to enable the parties put their arguments in writing.
