This comes after the CBN had last week, directed banks to implement a levy of zero point five per cent equivalent to half per cent of all electronic transactions, and to remit same to the national cybersecurity fund.
In the suit filed at the Federal High Court in Lagos, the Plaintiffs are asking the court to determine whether the CBN circular is unlawful and therefore ultra vires the apex bank.
According to a statement by the Deputy Director of SERAP, Kolawole Oluwadara, the Plaintiffs are also asking the court to determine whether such directive is not in breach of Sections Fourteen Subsection Two, Forty Four subsection One and One hundred and sixty two subsection one of the 1999 Constitution as amended, and therefore null and void.
They are asking for a declaration that the directive is contrary to the provision of the Cybercrimes Act and also seek an order of interim injunction restraining the CBN or its agents for enforcing the directive, pending the hearing and determination of the motion on notice filed in this suit.
No date has been fixed for the hearing of the suit.
