Nigeria’s Senate President, Dr BUKOLA SARAKI, has failed to use the court to stop his criminal trial at the Code of Conduct Tribunal.
After initially disqualifying himself from handling SARAKI’s latest application, Justice ABDUL KAFARATI of the Federal High Court sitting in Abuja today delivered ruling on a fundamental rights application by the embattled Senate President.Justice KAFARATI ordered Senator SARAKI to face his trial at the Code of Conduct Tribunal over alleged false declaration of assets to the Code of Conduct Bureau.Justice KAFARATI held that SARAKI’s application laced merit, adding that it appeared the Senate President was trying to stop his criminal trial by the CCT.The Judge declared that the Code of Conduct Tribunal is a competent court to try criminal matters similar to the charges brought against Senator SARAKI, stressing that the court cannot interfere in the matter.You will recall that the Justice KAFARATI had on 22nd March withdrawn from the suit filed by SARAKI on grounds that his integrity was had been called into question in the matter based on a report that was circulated through an online medium.The Judge had then said whether he ruled for or against SARAKI, his decision would be interpreted differently.However; the Chief Judge of the Federal High Court, Justice IBRAHIM AUTA, stepped in and prevailed on Justice KAFARATI to deliver his judgment on the matter.
