KANU’s lead counsel,IFEANYI EJIORFOR, insisted that his client who has not been seen since his altercation with troops at his country home at Afara-Ukwu in Umuahia, Abia State, last month is in the custody of the Nigerian Army.
EJIORFOR gave this indication while responding to questions from newsmen outside the courtroom of the Federal High Court sitting in Abuja.
The lawyer had earlier file a motion before Justice BINTA NYAKO, declaring that the whereabouts of NNAMDI KANU remained unknown since soldiers invaded his home.
Similarly; Senator ENYINNAYA ABARIBE who stood surety for NNAMDI KANU also filed a separate motion seeking to be relieved of the responsibility to produce NNAMDI KANU in court.
Senator ABARIBE informed the court through his lawyer, OGECHI OGBONNA, that he can no longer find NNAMDI KANU.
The move was made after counsel to the Federal Government LABARA SHAIBU urged the court to revoke the bail granted to NNAMDI KANU and also issue a bench warrant for the arrest of the IPOB leader for allegedly violating all his bail conditions.
In her ruling, Justice NYANKO ordered KANU’s sureties to make sure he appears in court in continuation of his trial, warning that the sureties risk forfeiture of their bail bonds.
Our correspondent JAMES IGAH reports that Justice NYANKO adjourned the case till 20th November for continuation of trial without considering Senator ABARIBE’s motion.
However; the Trial Judge gave Senator ABARIBE the options of producing the defendant in court before applying to be discharged as his bail surety; forfeit of his one hundred million naira bail bond, or to request for adequate time to produce NNAMDI KANU in court.
But ABARIBE’s lawyer settled for more time to produce KANU based on the insistence of the trial judge.
