Justice JAMES OMOTOSHO in a judgement on the controversy rocking the Edo state House of Assembly and National Assembly condemned what has described as infringing act of the National Assembly to interfere in Edo State House Assembly matters.
Justice OMOTOSHO further ruled that only the court of law has the power to make findings on issues bothering on State House Assembly after which the National Assembly can take over based on the court decision.
Justice OMOTOSHO emphasised that no constitution empowers the National Assembly to order the sealing of the Edo State Assembly with for any reason unless it has been empowered by the court of competent jurisdiction.
Speaking to newsmen outside the courtroom, counsel to the Edo State Governor, SANTOS OWOOTORI and counsel to Deputy Speaker of Edo state Assembly, KINGSLEY IDAHOSA described the judgement as beautiful and victory for democracy that would enable all tiers of government know their limits.
Our correspondent UCHENDU EJIOWHOR reports the counsel to National Assembly, SANDRA OSINACHI, who held brief for, the lead counsel, J .J USMAN, said though their preliminary objections were dismissed, the ruling stood as a victory for democracy.
It would interest you to know that the faction of Edo State House of Assembly led by the Deputy Speaker, YEKINI IDIAYE, and HENRY OKHUAROBO who represent Ikpoba-Okha constituency had filed a suit against the Edo State Governor and five others seeking to know if the defendants has the right to interfere in the functions of the state house of Assembly.
