Falana, however, asked the federal government to bring charges against both Bawa and the former governor of the Central Bank of Nigeria, Godwin Emefiele, who are currently being detained, if there exists substantial evidence of their involvement in criminal activities.
Bawa has been held in the custody of the Department of State Services for more than sixty days, without any formal charge or trial being presented against him.
Falana made the request in a statement, where he emphasized that Bawa’s continued detention is in violation of Section 493 of the Administration of Criminal Justice Act 2015 and Section 35 of the Constitution of Nigeria, which prohibit the detention of a criminal suspect for more than fifty six days without trial.
He argued that since no criminal charges have been levied against Bawa, the State Security Service should promptly release him from custody.
