Richard Abbey, who is a surveillance contractor had dragged the DSS to the state high court for enforcement of his fundamental human rights against the government agency over alleged unlawful arrest and detention which occurred on the 16th of July 2022.
Justice E.N Thompson in her judgment on the fundamental human right suit agreed with the plaintiff that the DSS detained him beyond the stipulated time thereby infringing on the fundamental human right.
Justice Thompson also ordered the DSS to tender an unreserved apology to Richard Abbey on a National Daily and placed a restraining order on the DSS to carry out further arrest of the applicant.
Speaking to today FM Uchendu Ejiowhor outside the court, counsel to Richard Abbey, Ajayi Olusegun described the judgment as justice for the common man that would serve as deterrence to security agencies to desist from carrying out unlawful arrest and detention.
On his part, Kingsley Briggs who represented the State Attorney General said the judgment would discourage the arbitrary arrest of innocent citizens by security agencies.
