One George Orlu and four others had approached the court requesting that primaries of the APC in the state be nullified following their alleged exclusion as delegates in the process.
Justice E.A.Obile in his judgment agreed with the plaintiffs that they were wrongly excluded in the election of delegates to participate in the party primaries.
Today FM’s Uchendu Ejiowhor reports that Justice OBILE also ruled that all those elected from the primaries should not be recognized as candidates.
Meanwhile, a Federal High Court sitting in Port Harcourt has adjourned till the 10th of November, 2022 for judgment in a matter instituted by the All Progressives Congress against all the state House of Assembly candidates of the People’s Democratic Party.
The APC had urged the court to direct the Independent National Electoral Commission not to recognize the State House of Assembly candidates of the PDP for allegedly violating the electoral act by failing to appropriately sign the register containing the names of the candidates and for late submission of register to the electoral body.
When the matter resumed, Counsel to PDP House of Assembly candidates, Emmanuel Ukala raised preliminary objection on jurisdiction of the court to hear the matter,which was argued at the point of law by counsel to APC, Chimenem Jerome.
Today FM’s Uchendu Ejiowhor reports that Presiding Judge, Justice OBILE after listening to the representatives of the parties, adjourned for judgment after parties argued and adopted their final written addresses.
Justice Obile in a separate suit filed by APC against PDP governorship candidate, Sim Fubara also adjourned to 9th of November, 2022 for judgment.
Speaking to newsmen outside the courtroom, one of the Counsels to APC, Chimenem Jerome highlighted some of the issues raised.
