Ronke Gberegbe who is the wife of late Chieftain of the People’s Democratic Party in Khana, Ferry Gberegbe had approached the court to enforce a her fundamental Human Rights against the defendants and demanded for a compensation for the murder of her husband who was allegedly killed during the last General election in Rivers State.
Our correspondent Uchendu Ejiowhor reports that the trial Judge, Justice Adolphus Enebeli who delivered the judgment, struck out the matter for lacking in merit.
Justice Enebeli premised the judgment on the mode of the application which he said ought to have come in form of writ of summon which gives room for witnesses and oral evidence and not originating summon.
Speaking to newsmen outside the court, counsel to the applicant, Lezina Amegwa said they will not appeal the judgment but will file a fresh charge against the defendants.
You will recall that there was a video circulated on Social Media showing the husband of the plaintiff, Doctor Ferry Gberegbe falling to the ground after sporadic shooting during Governorship election in Bori Rivers State and died after one week in Hospital.
But some stakeholders in the Ogoni have argued that the late Gberegbe did not die of the gunshots.
