SHEMA as well as SANI HAMISU MAKANA, LAWAL AHMAD SAFANA and IBRAHIM LAWAL DANKABA were meant to be arraigned before Justice MAIKAITA BAKO of the Katsina State High Court for the alleged criminal breach of trust, abuse of office and conversion of public funds to the tune of over eleven billion naira while he was in office as governor.
But the arraignment was stalled following a motion by the defendants challenging the jurisdiction of the court and the competency of the charges.
The motion was filed by counsel for the accused persons, JOSEPH DAUDU, and the prosecution counsel J.S OKUTEPA responded with a counter affidavit.
The prosecution also asked the court to remand the accused persons in prison custody until the next adjourned date on grounds that they violated the terms of the administrative bail granted to them by the EFCC.
However; the defence counsel argued that since the court was yet to assume jurisdiction to hear the matter, such application should not have come up.
After listening to the argument, Justice BAKO refused to remand the accused persons and adjourned the matter to 7th February for hearing of the motions on notice.
