Court dismiss reliefs sought by Arco Petrochemical Services against Nigeria Agip Oil Company over contract award dispute.

Arco had accused Agip of violating section three of the Nigerian Oil and Gas Content Development Act of 2010. 

 

But in his judgment, Justice ABDULAHI LIMAN said by virtue of section thirty-two of the Nigerian Oil and Gas Content Development Act, the plaintiff failed to prove that it was the only indigenous company that bided for the contract to maintain a gas turbine plant in Rivers and Delta states. 

 

Justice LIMAN said Agip was not under any obligation to award the contract to Arco simply because they scored the highest points during the bidding and technical evaluation exercise. 

 

 

Our correspondent reports that after delivering the judgment for over two hours, the trial Judge advised the parties to further test the decision at a higher court.

 

Speaking with newsmen outside the Courtroom, Counsel to Agip, JOHN IREHIME said the judgement has lifted all restrictions that has delayed the execution of the contract by another company.

 his part, BELU-OLISA NWOFOR who represented the Plaintiffs, Arco Petrochemical Services said they will Appeal the Judgement simply in the interest of other indigenous companies.
