Justice OKON ABANG of the court sitting in Abuja declined to grant the request for the Department of State Services to release DASUKI to testify in the case of four hundred million naira fraud against METUH.
Justice ABANG also refused to order the released of METUH’s international passport to enable him travel abroad for medical treatment.
The Trial Judge held that the application lacked merit and was done in bad faith with the intention of delaying the trial.
On the request to invite DASUKI, Justice ABANG ruled that the former NSA was not a compellable witness in the trial since the defendant had not made any effort to invite him and failed.
The Judge also demanded to know at what stage the defence decided to include DASUKI in its lists of witnesses.
But the ruling did not go down well with the defence team led by ONYEACHI IKPEAZU, who thereafter expressed lack of confidence in the court in handling the trial.
By the rulings, IKPEAZU who is a Senior Advocate of Nigeria, said Justice OKON ABANG has not only shown a clear bias against the first defendant.
He therefore prayed the court to recue itself from going on with the trial.
