The former Chairman of Asari-Toru Local Government council was granted bail in the sum of ten million naira and a surety who must be a resident of Port Harcourt.
In granting the bail; the two-man panel of the Appellate Court dismissed the preliminary objection by the Rivers State Government against the bail appeal by FLAG-AMACHREE.
The Appeal Court held that ill health is an exceptional circumstance that should have been taken into consideration by the lower court to grant bail to the accused person.
The Appeal Panel further declared that medical reports from three practitioners should have been put into consideration.
The Court also faulted Justice MARGARET OPARA of the lower court for improper use of her judicial discretion.
The Court of Appeal also entertained a second set of appeals arising from the second set of murder charges against OJUKAYE FLAG-AMACHREE.
It also set aside the prison remand order against the accused persons by the Chief Judge of Rivers State, Justice ADAMA IYAYI-LAMIKANRA.
