Appeal court dismisses suit seeking disqualification of Sim Fubara

The APC had filed a suit at the federal High Court asking the court to direct INEC to disqualify the governorship candidate of PDP for allegedly violating the electoral act by not dully signing the list of candidates of the party and for submitting the list later than stipulated time.

The Federal High Court presided over by Justice Emmanuel Obile had in his judgment struck out the suit for lack of jurisdiction which resulted in APC appealing the judgment.

When the suit came up before a three man panel of appeal led by Justice Muhammed Shuaibu, the parties were invited to explain why the court will not strike out the suit following a position earlier taken by the court in a suit by ADP and ADC against PDP.

Today FM’s Uchendu Ejiowhor reports that counsel to APC, Emenike Ebete who addressed the court withdrew the appeal against PDP’s, Similayi Fubara and INEC and the three man panel led by Justice Muhammed Shuaibu dismissed the suit.

Justice Shuaibu also cautioned lawyers who encourage clients to file unnecessary suit thereby wasting the time of the court and resources of the government.
