ABIODUN AGBELE was arrested and detained by the EFCC on the 1st of July, but Justice OLUKAYODE ADENIYI declared that the action by the anti-graft agency was wrong, unlawful, unconstitutional and a gross violation of his fundamental rights.

Justice OLUKAYODE ADENIYI condemned AGBELE’s detention without trial or lawful court order, and awarded compensation in his favour.

The Judge observed that the fundamental rights suit brought on behalf of AGBELE was already pending in court before the EFCC approached an Abuja Magistrate to secure a remand order.

AGBELE was detained by the EFCC in connection with an alleged one point three billion naira traced to the personal bank account of Governor AYO FAYOSE.

But in a court action instituted on his behalf by a Senior Advocate of Nigeria, Chief MIKE OZEKHOME and OLALEKAN OJO, AGBELE prayed the Abuja High Court to order his release on grounds of human rights violation and to award him five hundred million naira as compensatory damages for unlawful arrest and detention.
