A High Court in the Japanese city of Tokyo has reversed a landmark judgment in favour of the family of a Ghanaian immigrant who died in 2010 due to alleged excessive use of force by immigration authorities to enforce his visa-overstay.In reversing the Tokyo District Court’s ruling, the High Court said the force used to restrain forty-five-year-old ABUBAKAR AWUDU SURAJ was not at the level to stop his breathing and was not illegal.Contrary to the lower court document claiming that the deceased died of suffocation, the High Court said the deceased died of a rare heart condition.
Reuters international news agency reports that SURAJ was gagged and bound by Japanese immigration officials while on a plane prior to take-off.
