The ECOWAS Court declared that the continued detention of DASUKI without trial since December last year was in violation of both national and international laws on the right of citizens to freedom of liberty.

The decision of the court was made in a judgment delivered by Justice FRIDAY CHIJIOIKE NWOKE, who also awarded a fine of fifteen million naira against the Nigerian government as compensatory damages to DASUKI.

Justice NWOKE dismissed the allegations of unlawful possession of firearms and economic crimes slammed against DASUKI based on which he is being detained.

The ECOWAS Judge ruled that the Nigerian government missed the track because the applicant applied before the court for the enforcement of his breached fundamental right.

Justice NWOKE said that even if the applicant had committed a crime, the due process of the law must be observed in his trial.

It was also observed by the ECOWAS Judge that the applicant was put on trial in three different Nigerian High Courts and was granted bails by those courts.

Justice NWOKE said the action of the Nigerian government in subjecting DASUKI to detention without trial was condemnable because criminality has not been established against him.

He said the Nigerian government took laws into its hands and made mockery of the rule of law by arresting and detaining the applicant without warrants when he had legally being granted bail by the appropriate courts.
