Court of Appeal affirms election of Governor OKEZIE IKPEAZU of Abia

The Appellate Court also set aside the judgment delvered by a Federal High Court in Abuja that nullified the election of Governor IKPEAZU.

 

Ruling on the appeal brought by Governor IKPEAZU; the priding judge of the Appeal Court Panel, Justice PHILOMINA EKPEH declared that the lower court made a somersaults of the law.

Justice EKPEH averred that the lower court has no power to interpret a judgment of a superior court, as the judge declared that Governor IKPEAZU’s appeal as meritorious and went ahead to set aside the judgment of the lower court.

Our correspondent JAMES IGAH recalled that the trial, Justice OKON ABANG had on 27th June, ordered OKEZIE IKPEAZU to immediately vacate the Abia State governorship seat.

Justice ABANG also directed the Independent National Electoral Commission to issue fresh Certificate of Return to SAMPSON OGAH, who came second in the PDP governorship primary on 8th December, 2014.

Justice ABANG delivered the ruling in a pre-election matter brought by SAMSON OGAH over alleged false declaration in tax clearance forms submitted by Governor IKPEAZU before the election.
