A Rivers State High Court sitting in Port Harcourt has dismissed a suit filed by Okonkwo Fabian-Chikodi against the United Bank for Africa (UBA) Plc over the freezing of his bank account.
Fabian-Chikodi had approached the court seeking a reversal of the bank’s action and other related reliefs.
Delivering judgment, Justice Stephen Jumbo held that UBA acted lawfully and constitutionally, noting that the bank has a legal duty to enforce valid court orders.
Justice Jumbo further stated that it is not the responsibility of a bank receiving a freezing order to question or determine its validity before enforcing it.
The court, however, made no order as to costs, with neither the plaintiff nor the defendant awarded expenses.
