OJUKAYE’s lawyer, EMENIKE EBETE, gave this indication in court on resumption of trial of the case before Justice CHIWENDU NWOGU.
Following the development; Justice NWOGU adjourned the trial to 8th of February when the former Chairman of Asari-Toru Local government council is expected to take his plea.
Outside the courtroom, the defence lawyer told newsmen that his client would be present in court on the next hearing of the murder case if his condition improves.
But the state counsel, GODWIN OBLA, denied knowledge of any letter notifying the court about the ill health of OJUKAY FLAG-AMACHREE.
GODWIN OBLA also shed light on the background of the cases that were reassigned to two different courts.
You will recall that the OJUKAYE murder trial was reassigned to two different judges of the Port Harcourt High Court on the resumption of the matter yesterday.
The State Chief Judge, Justice IYAYI LAMIKANRA was personally handling the case until October last year when she decided to withdraw from the matter due to series of petitions against her that were being investigated by the National Judicial Council.
