The Economic and Financial Crimes Commission has been ordered to pay the sum of ten million naira to an expatriate who was detained unlawfully.Justice PETER AFFEN of the High Court of the Federal Capital Territory made the order in favour of WOLGANG REINL, who is an Abuja based foreigner and security expert.The amount is to cover compensatory damages for the violation of REINL’s fundamental rights to dignity of human person and personal liberty. Justice AFFEN also order EFCC to release the international passport, cheque books and cell phones that were seized from the plaintiff in the wake of his arrest and detention, as well as the removal of his name from a watch-list.The Austrian security consultant had approached the court through his lawyer, AFAM OSIGWE, to challenge his arrest and detention from December 12, 2015 to February 2, 2016.The court held that the detention of the plaintiff at the EFCC custody in Abuja for over a month was unlawful, unconstitutional and constituted a gross violation of the fundamental right to dignity of the plaintiff as enshrined in the 1999 Constitution.
