SHERIFF had argued that the Senator AHMED MAKARFI-led group lacked the authority to initiate any legal action on behalf of the PDP.
He claimed that the National Caretaker Committee was not recognized by the party, and that he had not authorized anyone to file any legal action, as the National Chairman of the party.
But in its ruling; the Supreme Court dismissed SHERIFF’s application against the motion of appeal filed by Senator MAKARFI and members of his faction.
According to the ruling delivered by the Chief Justice of Nigeria, Justice WALTER ONNOGHEN, the Apex Court held that there was nothing wrong with the appeal, as it was filed within the specified time limit.
Following the development; the Supreme Court will now go ahead to hear the appeal filed by the MAKARFI group on its merit.
The main appeal seeks to upturn the judgment of the Port Harcourt Division of the Court of Appeal, which held that SHERIFF was the authentic National Chairman of PDP.
