SUPREME COURT DISCHARGES SARAKI

The Supreme Court has upheld the appeal by Senate President Bukola Saraki and discharged him of the remaining three charges of false declaration of assets.

 

The decision of the apex court is based on a lead judgment delivered by Justice Centus Nweze in respect to the cross-appeals by Senator Saraki and the Economic and Financial Crimes Commission, EFCC.

 

Senator Saraki had challenged the ruling of the Court of Appeal, which asked the Code of Conduct Tribunal to try him on three of eighteen counts of false declaration of assets, while the EFCC had sought to reinstitute all original eighteen counts.

 

The judgment, which was unanimously supported by the five man-panel of the Supreme Court, vacated the ruling of the Appeal Court, which held that Saraki had questions to answer on charges four, five and six, in respect to non-declaration of assets and money laundering before the Code of Conduct Tribunal.

 

The Apex Court noted that since the lower court held that the prosecution failed to call those who had direct knowledge about the facts of the case and then turned around to rely on parts of it to reach its position, hearsay evidence cannot be used as proof to establish a prima facie case.
