Court of Appeal in Port Harcourt strikes out PDP case against state assembly candidates of APC

Justice Olabode Adegbehingbe ruled that the PDP has no locus standi to challenge the primary election of the APC in the first place. 

The judge also held that the Federal High Court lacked jurisdiction to entertain the suit and its decision which disqualified the candidates of the APC  was a nullity.

For your information, Justice Turaki Mohammed of the federal high court in Port Harcourt had on the 11th November 2022 nullified the candidacy of sixteen APC candidates in the suit filed by the PDP.

Our judiciary Correspondent reports that Justice Olabode Adegbehingbe also struck out the suit by the PDP seeking the court to nullify the remaining 16 APC state Assembly candidates whose candidacies were validated by the federal high court on the 1st of November 2022.

In the meantime, the Rivers APC 2023 Campaign Council says by Thursday’s judgments by the Court of Appeal have given Rivers people their best New Year gift for 2023.

The spokesman of the Campaign Council Sogbeye Eli commended the courage of the Justices of the Court of Appeal and described the judgments as a resounding victory for democracy.

He said Justices of the Court of Appeal rose to the call of duty to save democracy from the devices and pranks of anti-democratic forces.

 

Sogbeye Eli, therefore, advised the Rivers electorate to reciprocate the opening up of the democratic space by the Judiciary and vote for the APC candidates on March 11.
